Recently, Fairchild has once again launched a new wave of US patent infringement lawsuits against Power Integrations (PI)'s LinkSwitch-PH LED power conversion product line.
Fairchild pointed out that its three patents for the new-side adjustment technology for LED power conversion were infringed by PI, and the complaint was filed in the District Court of Delaware.
It is understood that the Delaware District Court jury on October 27 ruled PI's LinkSwitch-II and LinkSwitch-CV product lines, namely LNK603-606/613-616, SC1092, SC1097-99, SC1103, LNK632DG and LNK623- 626 et al., and all related products having substantially equivalent infringing circuits, constitute a patent infringement of Fairchild's US Patent No. 7,259,972. However, the jury found that two of the four US patents of PI constituted infringement, the other two were not infringed, and the allegedly infringing Fairchild products included some PWM controller products.
Fairchild said it has introduced a next-generation pin-compatible product that will replace the products affected by the latest ruling and will proactively inform customers about the products affected by the lawsuit.
In addition, Fairchild maintains a patent infringement lawsuit against PI Company of Suzhou, China, and believes that PI infringes on three Chinese patents of Fairchild Semiconductor. Fairchild also seeks to apply for an injunction against PI infringing products and requires millions of dollars in damages.
The two companies are still awaiting a US Court of Appeals for the Federal Circuit to rule on a 2004 lawsuit appeal; and another lawsuit involving two companies claiming that the other party constitutes a patent infringement, It is scheduled to be heard in the Federal Court of San Francisco, California in 2013.
