The "Regulations" include 6 chapters and 43 articles, which shall come into force on October 1, 2008. This regulation aims to promote energy conservation in public institutions such as state agencies, institutions, and organizations that use all or part of fiscal funds, improve the energy efficiency of public institutions, and play a leading role in the energy conservation of public institutions.
The "Regulations" require public institutions to strengthen energy management, adopt technically feasible and economically reasonable measures, reduce energy consumption, reduce and stop energy waste, and effectively and rationally use energy.
The above-mentioned regulations also require public institutions to designate special personnel to be responsible for energy consumption statistics, truthfully record the raw data of energy consumption measurement, and establish statistical accounts. The public institution shall submit a report on the energy consumption of the previous year to the agency of the administrative department of the people's government at the same level before March 31 of each year.
According to the "Regulations", the State Council and the agencies at the local level and above the people's governments at all levels must carry out energy conservation publicity, education and training in public institutions and popularize energy-saving scientific knowledge. The person in charge of the public agency is fully responsible for the energy conservation work of the unit.
The "Regulations" pointed out that the energy-saving work of public institutions should implement the target responsibility system and the evaluation system, and the completion of energy-saving targets should be taken as the content of the assessment and evaluation of the heads of public institutions.
The "Regulations" require the State Council and the local government departments at or above the county level to work with the relevant departments at the same level to formulate energy conservation plans for public institutions at this level in accordance with the medium- and long-term special plans for energy conservation at the people's government at the same level. Public institutions should implement energy consumption measurement systems, differentiate energy use types, energy consumption systems, energy consumption households, classification, and sub-item measurement, and monitor energy consumption status in real time to detect and correct energy waste in a timely manner.
The "Regulations" emphasize that any unit or individual has the right to report the waste of energy by public institutions, and the relevant departments should promptly investigate and handle the report. Units and individuals that have made outstanding achievements in energy conservation work in public institutions shall be commended and rewarded in accordance with state regulations.
If a public institution violates the above provisions, it will face penalties for correction, notification, and administrative sanctions within a time limit; the staff of the administrative organ affairs agency will abuse their powers, neglect their duties, and engage in malpractices in the supervision and management of energy conservation in public institutions, which will constitute a crime. Criminal responsibility shall be investigated; if it does not constitute a crime, it shall be punished according to law.
